Terms of Service v2.0

Legal operating standards for the Colorcloud ecosystem.

1. Acceptance of Terms

By accessing and using Colorcloud, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service.

2. License Grant

Colorcloud grants you a limited, non-exclusive, royalty-free license to use our tools for personal, educational, and commercial purposes. You may not:

•Reverse-engineer or attempt to access our proprietary algorithms

•Use automated scraping tools to extract color databases

•Redistribute our software or claim it as your own

•Use the Service for illegal purposes or in violation of regulations

3. Ownership of Generated Content

Any color palette, gradient, or design synthesized using Colorcloud is yours to use commercially. We claim no ownership over:

•Color combinations you create

•Palettes you upload or download

•Gradients generated using our tools

•Screenshots or exports you create

You are free to use your creations in personal projects, client work, or commercial products without license or attribution to Colorcloud.

4. Acceptable Use

You agree not to:

•Inject malicious code or scripts into our platform

•Perform automated scraping of color databases

•Attempt to gain unauthorized access to user accounts

•Spam or abuse community features (Social Feed, comments)

•Violate intellectual property rights of others

•Engage in harassment or hate speech

Violations may result in immediate account termination without refund.

5. Limitation of Liability

Colorcloud is provided as-is without warranties of any kind. We are not liable for:

•Chromatic variance between digital simulations and physical manufacturing results

•Loss of color data due to device failure

•Inaccuracies in industrial color matching (always verify with physical swatches)

•Third-party service outages (Firebase, Google, etc.)

•Indirect or consequential damages related to your use of the Service

6. Service Availability

We maintain a 99.98% uptime protocol but cannot guarantee 100% availability. We are not responsible for:

•Scheduled maintenance windows (announced in advance)

•Security incidents or cyberattacks

•External service outages

•Acts of God or force majeure

During outages, your local color data remains accessible in your browser.

7. Manufacturing Disclaimer

IMPORTANT: Colorcloud provides digital color simulations for reference only. Due to substrate variance, lighting conditions, and manufacturing processes:

•Digital colors may not exactly match physical output

•Always verify your color choices with physical swatches before production

•Industrial color matching requires professional color measurement tools

•We recommend professional color consultation for critical manufacturing applications

8. Modification of Service

We reserve the right to modify or discontinue Colorcloud (or any feature) at any time with 30 days notice. If we discontinue the Service:

•We will provide instructions to download your color data

•Paid account credits will be refunded pro-rata

•Your palettes will remain downloadable for at least 90 days

9. Termination

We may terminate your access to Colorcloud if you:

•Violate these Terms of Service

•Engage in fraudulent or illegal activity

•Harass other users or violate community guidelines

•Use the Service more than 30 days after account suspension notice

Termination is effective immediately, and no refunds will be issued.

10. Indemnification

You agree to indemnify and hold harmless Colorcloud from any claims, damages, or expenses arising from:

•Your violation of these Terms

•Your use of the Service

•Your content uploaded to the Service

•Your interaction with other users

11. Changes to These Terms

We may update these Terms periodically. Material changes will be announced via email or prominent notice. Your continued use of Colorcloud constitutes acceptance of updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
